Homeowners and condominium associations are prevalent throughout Florida. They are designed to establish rules, covenants, guidelines, and restrictions to protect the value of each owner's property, house, or unit. From assisting developers in the creation of Declarations, Covenants, and By-laws to establishing rules, policies, and procedures for the day to day operations of the community, to the transfer of control from the developer, we actively work hand in hand with our clients.
We assist in establishing governing documents as well as advise on interpreting existing records and enforcement of pre-existing declarations, covenants, and architectural review guidelines.
We also serve as general counsel to HOAs, work with CAMS and address individual homeowner disputes. Florida laws provides extensive guidance and requirements for HOAs and provides various causes of action for violations of governing documents. We understand and appreciate the needs associations and their members, and work to insure HOAs do not become overly intrusive as well as work to make sure members understand and follow their HOA guidelines.
Finally, we not only represent HOAs and their members, but also have served to provide mediation services when needed.
